Thank you for purchasing and /or taking a NYC PRIVATE SHOPPING TOUR.
These terms and conditions shall govern all tours operated by NYC PRIVATE SHOPPING TOUR/Bibelot NYC, Inc. BY purchasing or taking a NYC PRIVATE SHOPPING TOUR, you affirm that you have fully understood and agree to these terms and conditions.
RAIN OR SHINE
NYC PRIVATE SHOPPING TOUR operates rain or shine. There are NO REFUNDS for inclement weather
NO REFUNDS
All sales are final. Tours are only valid for the date and time stated in the e-mail confirmation.
Should you need to cancel a tour, cancellation is required 3 business days in advance of the scheduled tour for a full refund, less any PayPal or credit card fees. For cancellations less than 3 business days in advance of the tour a $100.00 cancellation fee will be deducted from the payment. There is no refund for no-shows.
NYC PRIVATE SHOPPING TOUR/Bibelot NYC, Inc. reserves the right to deny rescheduling requests for cancelled or no show tour groups.
Notwithstanding the foregoing, NYC PRIVATE SHOPPING TOUR/Bibelot NYC, Inc. reserves the right to cancel all tours at any time due to guide unavailability or other events that may make it impossible for NYC PRIVATE SHOPPING TOUR/Bibelot NYC, Inc. to conduct the tour at the stated date and time, and, in the event of cancellation by NYC PRIVATE SHOPPING TOUR/Bibelot NYC, Inc. you will be given the option to 1) be refunded the full ticket price or 2) reschedule the tour at a different time.
PARTICIPANT’S MEDICAL AND HEALTH CONDITIONS
Like most tours in New York City, NYC PRIVATE SHOPPING TOUR tours usually involve a significant amount of walking. It is the tour participant’s responsibility to inform NYC PRIVATE SHOPPING TOUR/Bibelot NYC, Inc.’s guide of any medical and health conditions that may make the participant unable to participate or especially susceptible to injury. The guide reserves the right to disqualify any participant at any time if the guide believes that the participant is incapable of participating in the tour, the participant is at risk of injury by participating in the tour and/or the participant’s participation will jeopardize the safety or enjoyment of the tour by other participants. Refunds are not given under such circumstances.
RIGHTS
NYC PRIVATE SHOPPING TOUR/Bibelot NYC, Inc. reserves the right to use photos taken on your tour of you and/or all participants for publication use in the US and internationally including new media such as Facebook, Twitter, Instagram, Pinterest, TripAdvisor, websites, newspapers and magazine publications (print or online).
Please advise us by email, in advance of booking payment, if you have any privacy concerns so it may be determined if NYC PRIVATE SHOPPING TOUR can accommodate your concerns.
RELEASE OF LIABILITY
NYC PRIVATE SHOPPING TOUR tours take place in public venues under conditions largely beyond the company’s control.
Assumption of Risk: By purchasing and/or participating in a NYC PRIVATE SHOPPING TOUR/Bibelot NYC, Inc. tour, to the fullest extent permitted by law, you and all participants assume all risks, known and unknown, foreseeable and unforeseeable, in any way connected with the purchase of and/or participation in the tour.
No Liability Unless Gross Negligence or Willful Misconduct: Damages capped at $500.00: By Purchasing and/or participating in a NYC PRIVATE SHOPPING TOUR/Bibelot NYC, Inc. tour, to the fullest extent permitted by law, you assume the responsibility and liability for, indemnify and hold harmless, and forever and unconditionally release NYC PRIVATE SHOPPING TOUR/Bibelot NYC, Inc., its owners, directors, officers, agents, principals, employees, and guides and other independent contractors (collectively ,The “Released Entities”) from any and all claims, actions, damages, liabilities, losses, costs and expenses (including, without limitation, attorney’s fees) for death, injury, or loss or damage of property (collectively, “Claims”) in any way arising out of your purchase of and/or participation in the NYC PRIVATE SHOPPING TOUR tour, including, without limitation, any and all Claims resulting from or arising out of the negligence or fault of any of the Released Entities. NYC PRIVATE SHOPPING TOUR/Bibelot NYC, Inc.’s liability to tour purchasers and participants shall be limited to actual damages arising from the Released Entities’ gross negligence or willful misconduct in the performance of their duties and responsibilities hereunder; provided, however, under no circumstances shall damages in connection with a purchaser’s purchase of a NYC PRIVATE SHOPPING TOUR tour or a participant’s participation in a NYC PRIVATE SHOPPING TOUR tour be greater than $500. All liability arising out of a purchaser’s purchase or participant’s participation is cumulative and not per incident. In no event shall NYC PRIVATE SHOPPING TOUR/Bibelot NYC, Inc. be liable for any special, incidental, punitive or consequential damages or other indirect damages, even if NYC PRIVATE SHOPPING TOUR/Bibelot NYC, Inc. has been informed of the possibility thereof.
Binding Effect
The terms and conditions herein shall be binding upon purchaser and participant’s next of kin, personal representatives, heirs, beneficiaries and assigns and shall inure to the benefit of NYC PRIVATE SHOPPING TOUR/Bibelot NYC, Inc., its successors and assigns.
